The Supreme Court has been told that allowing ministers to trigger Brexit without the consultation of MPs would “violate” basic principles of constitutional law.
Lord Pannick QC has said Junes EU referendum is political and not legal, he also added that any Commons votes related to Brexit were irrelevant to the case.
The government has insisted that they can trigger Article 50 of the Lisbon Treaty without the say of parliament.
Lord Pannick is representing Gina Miller in the hearing, he says there is nothing in UK legislation that gives the government the power to act alone.
He said, the law, “simply says there should be a referendum – it says nothing more” and that it was designed to advise parliament and the government.
He also said it did not intend to hand ministers the power to invoke Article 50.
The justices’ in the Supreme Court are expected to make a decision in January.
