The Queen is ‘not above the law’ says SNP

After the historic Supreme Court ruling on Tuesday where 11 justices ruled the suspension of parliament was unlawful, the SNP hit out at the Queen.

Joanna Cherry QC and SNP MP said after the ruling, “This is a huge victory for the rule of law and for democracy and it’s very much in keeping with the Scottish Constitutional tradition that neither the Governments, nor indeed the monarch, are above the law.

“This is an absolutely momentous decision. The Supreme Court has unanimously ruled that parliament has not been prorogued.

“There is nothing to stop members of Parliament such as myself and colleagues from resuming immediately the important job of scrutinising this minority Tory government as we hurtle towards Brexit.

“As a Scot and a lawyer, I am absolutely delighted the United Kingdom Supreme Court has agreed with Scotland’s Supreme Court that the prorogation was unlawful and therefore it is null and void.”

Lady Hale said in her judgement this morning, “The court is bound to conclude, therefore, that the decision to advise Her Majesty to prorogue parliament was unlawful because it had the effect of frustrating or preventing the ability of parliament to carry out its constitutional functions without reasonable justification.”
